Social Media Promotional Terms & Conditions

By participating in any Wildz Social Media Promotion (“Promotion”), You agree to these Promotional Terms and Conditions (“Terms”). Wildz.de’s General Terms and Conditions and Privacy Policy also apply.

1. Organiser

1.1 The organiser of the Promotion is Rootz Ltd. (hereinafter “we” or “the organiser”), with its registered office at Ewropa Business Centre, Level 3 - 701, Dun Karm Street, Birkirkara, BKR 9034, Malta, which offers it on Wildz.de social media profile. Rootz Ltd. operates its offer with a permit from the Gambling Authority of the Federal States (GGL) with licence number 208.1.1-02254-Rootz Ltd. Permission was granted on September 15, 2022, for the operation of virtual slot machines per §§ 4 to 4d in conjunction with 22a GlüStV 2021 throughout Germany.

2. Description of the Promotion

2.1 The Promotion is a time-limited social media campaign on Instagram, allowing registered users of both platforms who meet the eligibility criteria to have the chance to win a specified prize as described below.

2.2 We will share all the information about our promotion, including duration, prizes, and specific participation conditions, by posting on the social media platform where the promotion is announced (Instagram). Wherever possible, we will also communicate this information through other methods, such as newsletters. Before participating in this promotion, You need to read and understand the promotion details and participation conditions provided in the posts or newsletters.

3. Duration of the Promotion

Wildz.de will communicate the duration of the promotion in each specific social media post.

4. Participation Conditions

4.1 To participate in the Promotion, you must meet the specific conditions mentioned in Wildz.de’s Posting or newsletter.

4.2 You must fulfil the following eligibility criteria:

• You have a registered and verified player account at Wildz.de per Wildz’s General Terms and Conditions.
• You have a permanent residence in Germany.
• You are eighteen (18) years of age or older.
• You have not been excluded from any Rootz brand or self-excluded in the national player exclusion system OASIS.
• You are not an employee or contractor of Rootz or any affiliated company or a family member of such.

4.3 You can only enter the promotion once. If you try to enter multiple times, such as by leaving several comments on the Posting, it will count as a single entry.

5. Prize

Each Wildz.de social media post or newsletter will include information about the prize and specify if one or multiple prizes will be awarded.

6. Selection of the winner:

6.1 A random draw will determine the prize winner within 48 hours after the promotion ends, using this feature.

6.2 Wildz.de reserves the right to choose alternative winners to whom the prize will be awarded if the original winner fails to meet the participation terms and the winner selection criteria and/or accepts the prize. If the prize is transferred to a new winner, the new winner will assume all rights and responsibilities as outlined in these Terms, and Wildz.de will contact the new winner accordingly.

6.3 There is no legal entitlement to the prize. Wildz.de reserves the right to replace the prize with monetary or non-monetary compensation of similar value. The winner is not entitled to request the exchange of the prize for monetary or non-monetary compensation. The winner is not permitted to transfer the prize to third parties. Wildz.de may require the winner to pay any taxes and duties that may apply to the prize or its delivery. Wildz.de shall not reimburse the winner for any costs incurred in participating in or winning the promotion. Wildz.de states that it is not the manufacturer or producer of the prizes and does not accept any liability for any damage to the prize or potential damages arising from its use.

7. Acceptance of the prize and communication

7.1 Once the winner is selected, we will contact them within 48 hours after the end of the promotion via direct message on Instagram to confirm if the winner meets the participation terms and selection criteria mentioned earlier. For verification purposes, the winner may be required to provide their Wildz.de username and email address. We may need additional information or documents to ensure the participation conditions have been met.

7.2 If the winner meets the participation conditions and selection criteria, provides all necessary information requested by the organiser, and accepts the prize within 48 hours after the initial communication, the prize will be delivered either by courier, email or in the case of game credits, through in-game actions. If courier delivery is chosen, the timing will depend on external courier services, and we cannot guarantee a specific delivery timeframe.

7.3 If the winner does not meet the requirements outlined in these Terms, declines the prize, fails to respond within 48 hours of the initial communication, and no alternative winner is selected, the prize will be considered unclaimed.

8. Publication of the winner

8.1 The winner will be announced (with their personal data as outlined in Article 9.3 below) on social media platforms and/or the Wildz.de website.

9. Data Protection

9.1 Rootz, as the data controller, collects and processes participants’ personal data to achieve the promotional campaign’s objectives and to provide remuneration to the participants. These processing activities comply with Wildz.de’s Privacy Policy and relevant data protection regulations. Rootz will process the Personal Data per Article 6(b) GDPR. By participating in the promotional campaign, you consent to using your personal data as described in this document and Wildz.de’s privacy policy. Participants have the right to withdraw from the promotional campaign at any time.

9.2 By participating in the promotional campaign and winning, you acknowledge that specific personal data, such as your first name or social media username, may be published on social media platforms and/or the Wildz.de platform. Additionally, with the explicit prior consent of the winner, we may publish a photo of the winner and audio and video recordings.

9.3 The personal data processed in connection with this promotional campaign is limited to necessary information, including first name, social media username, Wildz.de email address, and registered address. The Data collected shall be deleted at the latest one (1) month after the promotional campaign has expired and a winner has been announced.

9.4 Personal data may only be shared with the following third parties:

• Limited to first name and username on the social media platform to use the Free Instagram Comment Picker and Giveaways Tool, as per point 6.1 of these Terms and Conditions
• With the relevant courier service to deliver the prize.

9.5 If a participant mentions another user’s personal data (such as their first or last name) in a post or comment on the social media platform, the participant is responsible for obtaining the necessary consent to share that personal data and for directing the individual to the information explaining how we will process the personal data.

10. Final Provisions

10.1 This promotional campaign is not sponsored, endorsed, managed, or associated with Instagram in any way.

10.2 Wildz.de reserves the right to contact participants in this promotional campaign (e.g., for surveys or feedback). Participation in such surveys and feedback is voluntary and will not impact this promotional campaign.

10.3 This promotional campaign does not change the course of play or the game’s rules on Wildz.de outside the promotional campaign.

10.4 We have the right to make decisions regarding all matters related to this promotional campaign and to limit, postpone, interrupt, amend, or cancel the campaign at any time. In such cases, participants will be informed of the changes as soon as possible through appropriate notice. We reserve the right to review all participants, refuse the award of a prize, withdraw a prize claim, and/or refuse further participation in the promotional campaign if:

• There are legitimate reasons to believe that these or the General Terms and Conditions have been violated.
• A participant has gained an unfair advantage through participation in the promotional campaign or has won by fraudulent means.
• A participant is prohibited from receiving any prize or compensation under the relevant anti-money laundering regulation or other applicable legal provisions.
• In the event of disputes related to the promotional campaign, our decision is final and binding.

10.5 We reserve the right to modify these Terms and Conditions in written form. If any of these clauses prove illegal, invalid, or otherwise unenforceable, they will be removed from these Terms and Conditions. The remaining provisions will not be affected and will remain in full force and effect.

10.6 These Terms and Conditions are governed by and construed under the laws of Germany. Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the German courts.
